Are Home Healthcare Workers Entitled to Overtime in Illinois?

Home healthcare workers are entitled to overtime in many situations in Illinois and elsewhere. The Department of Labor has explained the changes to the overtime rules governing overtime payments for home healthcare workers. Many home health care workers perform work for which they are not paid (travel, driving, certain types of care) or they are not paid overtime. The Department of Labor has explained the rights of at home/home health care workers for overtime as follows:

“The Department recently revised its regulations defining companionship services so that many direct care workers, such as certified nursing assistants, home health aides, personal care aides, and other caregivers are protected by the FLSA. The Department also revised the regulations concerning live-in domestic service workers.”
