Class Actions

Areas of Practice Class Actions and Consumer Law

Class action lawsuits are brought on behalf of a large group of plaintiffs. Courts will sometimes permit groups of similarly situated plaintiffs to join together to remedy a legal right when there are common issues in the case. Examples of Mr. Fish’s experience in class action or derivative lawsuits include:

  • We defended a putative nationwide class action seeking in excess of $5 million that alleged our client (through its agents) and a national publishing company had caused the transmission of unauthorized text (SMS) messages to cellular telephones in violation of the Telephone Consumer Protection Act (TCPA). Without paying any money whatsoever, our client was voluntarily dismissed with prejudice less than 10 months after the lawsuit was filed and prior to class certification consideration. The case proceeded against another defendant who had been sued along with our client. (Northern District of Illinois, Opposing Counsel: Edelson McGuire)
  • Helping to recover million dollars on behalf of investors who suffered losses as a result of the Enron and Refco bankruptcies;
  • Defended a hotel against a putative class action employment lawsuit that alleged violations of wage and hour laws, including the Illinois Wage Payment and Collection Act, the Fair Labor Standards Act, defamation, and discrimination. (December 2007, Judge Grady, Northern District of Illinois)
  • Bringing lawsuits against companies who allegedly placed spyware on computers without consent.
  • Suing on behalf of minority shareholders who were forced out of a bank and paid an allegedly unfair price for their stock when the bank converted from a C to an S Corporation. Click here for court order granting class certification in minority shareholder class certification ruling.
  • Participated in employment wage claims on behalf of employers and employees in cases involving unpaid wages and wage deductions.
