A few examples of our intellectual property litigation includes:
- Defending a Naperville, Illinois marketing company after it was sued in San Francisco, California for trademark, copyright, and trade secret infringement where the plaintiff sought over $80,000,000. Mr. Fish successfully prevented the entry of a temporary restraining order. After detailed discovery, the court also refused to enter a preliminary injunction. Ultimately, the case settled without our Naperville, Illinois client paying a penny to the plaintiff and without any interruption to its business. The case was resolved in less than 6 months.
- Assisting in obtaining an approximately $2.8 Million judgment against a publicly traded company in an intellectual property/patent infringement lawsuit in Chicago, Illinois. The presiding federal judge awarded enhanced damages as a matter of law after concluding that "no reasonable jury could find other than that clear and convincing evidence exists that…Defendants were willfully infringing…and the amount of damages awarded should be enhanced."
- Defending an Illinois limited liability company (LLC) against a copyright infringment lawsuit seeking $2.75 million in damages.

For example, after learning that their trademarks were registered as someone else's domain name, two clients recently hired the Fish Law Firm to win back the domain names. - Obtaining a $2 + million judgment (via a jury trial) in an unfair competition lawsuit after Mr. Fish's client learned that (among other things) an industry competitor was unfairly disparaging its products in the marketplace.
