Illinois Has Its Own Laws That Govern Workplace Employment Cases 

Illinois has several specific laws that govern the workplace.  For example, the Illinois Human Rights Act (IHRA) provides a comprehensive framework for addressing employment discrimination and ensuring workplace fairness. 

  • The IHRA applies to employers with 15 or more employees, but certain provisions might cover smaller employers in specific contexts.  This law applies to employers in Illinois. 
  • It protects against discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, ancestry, age (40 and over), marital status, disability, and military status among other protected classes.
  • Illinois Employers are prohibited from discriminating in any aspect of employment, including hiring, firing, promotions, compensation, job training, and other terms and conditions of employment.
  • Harassment based on any protected characteristic is also unlawful. This includes both quid pro quo harassment and hostile work environment harassment. 
  • Employees who believe they have been discriminated against may file a complaint with the Illinois Department of Human Rights (IDHR).  There are strict Illinois-specific deadlines to do so.
